In an action to recover damages for wrongful death, the plaintiff appeals from an order of the Supreme Court, Orange County (Barone, J.), dated August 26, 1993, which denied her *529motion to strike the defendant’s defense predicated upon General Obligations Law § 9-103 and granted the defendant’s cross motion for summary judgment dismissing the complaint.

Ordered that the order is affirmed, with costs.
