“ VII. That heretofore and on or about the 23rd day of March, 1923, the said defendant, acting by and through the said Harry Burken, its president, duly employed this plaintiff as broker, to offer the aforementioned premises for sale and to find a purchaser for the said premises for the sum of $300,000, with $50,000 cash, and by taking said premises subject to a first mortgage in the sum of $150,000, payable about May, 1924, bearing interest at the rate of 5% per annum, and by such purchaser executing and…
