The appellant was convicted of second degree murder in the district court of Chaves county on change of venue from Lea county, and prosecutes this appeal from the judgment of conviction. He first complains that the district court of Chaves county never acquired jurisdiction to try the case by reason of the following facts: Great feeling appears to have been engendered as result of the killing out of which the prosecution arose.
