The history of the case, as shown by the facts and the record, is this: In May, 1836, the defendants here, together with twenty five others, all residents in Baltimore, Maryland, entered into articles of co-partnership, by the name of the “Baltimore and Western Land Association,” for the purpose of buying and selling, and speculating in lands in the State of Illinois and elsewhere, with a capital of $20,000.
