Appeal by. the defendant, Harry A. Briggs, from a judgment of the County Court of Ulster county in favor of the plaintiff, entered in the office of the clerk of said .county on the 25th day of May, 1909, upon the decision of the court rendered after a trial before the court without á jury.

Houghton, J.:

On the 31st day of January, 1907, the plaintiff was owner of real property consisting of a farm, upon which there was a house and outbuildings, in the county of Ulster and in the territory deemed necessary by. the board of water supply of the city of New York to be taken for the purpose of furnishing an additional supply of water to that city, and which has since become known as the" Ashokan reservoir. On that day the city of New York caused to be filed a map covering the property in question, thereby instituting condemnation proceedings in conformity with chapter 724 of the Laws…
