This is an appeal on questions of law from a judgment of the Common Pleas Court rendered on the verdict of a jury finding the defendant guilty of murder in the first degree, without a recommendation for mercy.

Two errors were assigned, but during the oral presentation of the case before this court, counsel for the defendant, appellant herein, withdrew the first assignment of error, leaving only the second alleged error for our consideration.
