Plaintiff, John Washburn, as liquidator of Mile Square Health Plan of Illinois, petitioned the circuit court for a rule to show cause against defendants, Scott Weiss, an attorney, and the law firm of Orlikoff and Flamm, for defendants’ failure to turn over to the liquidator files relating to their representation of Mile Square Health Plan. The trial court denied plaintiff’s petition on the ground that the defendants had a valid common law retaining lien on the documents in their possession, and ordered defendants to release the documents when the plaintiff had provided substitute adequate…
