This is' an action for damages against the city of Kirksville, a- city of the third class, caused by plaintiff falling through a defective culvert over a street crossing, whereby she was severely injured. The culvert was about four feet long and about the same width; and was a part of the crossing and connected the sidewalk on the west side of Sixth street with the brick part of the street crossing at the intersection of Filmore and said Sixth street.
