On November 4, 1878, Lewis Summers filed his petition in the county court of Kanawha county, .alleging, that on Feb*161ruary 10, 1871, he sold and eohveyed to J. B. Walker a tract of land containing 160 acres, at the price of $40,000.00; that to secure the payment of the unpaid purchase-money, viz : $37,000.00, with interest from that date, the said Walker on the same day, conveyed said land to W.
