*604Appellant was convicted for the offense of “Operating a motor vehicle upon a public highway * * * while under the influence of intoxicating liquor,” in a trial before the court, without the intervention of a jury, in County Court at Law No. 3 of Bexar County. His punishment was assessed by the court at a fine of $50 and three days in jail.
