OPINION OF THE COURT

Mollen, P. J.

On December 4, 1980, a conflagration at the Stouffer’s Inn of Westchester claimed the lives of 26 people. Defendant, Luis Marin, was subsequently indicted, tried and found guilty by a jury of murder in the second degree (26 *15counts) and arson in the fourth degree in connection with the tragedy. That verdict was set aside by the Trial Judge and the indictment was dismissed. The issue on this appeal is whether the evidence presented at trial was legally sufficient to prove that the defendant had intentionally caused the fatal fire.
