The plaintiff in error, hereinafter called defendant, was convicted of grand larceny and sentenced to serve a term of one year in the state penitentiary.
The circumstances shown by the record are about as follows: On Friday night, October 31, 1924, three bales of cotton belonging to three different men were stolen from the ginyard at Matoy, Bryan county. The cotton was taken from the ground in the ginyard. On this night defendant and Bill Brown were together near the place engaged in a gambling game.
