HOLMES, Circuit Judge.

This appeal is from a judgment for appellee in an action for the wrongful death of her husband and intestate, Horace Franklin.

Appellants contracted with the state of' Alabama for the construction of a road from the town of Opp to the town of Andalusia, both in said state.
