The action was commenced to foreclose a mortgage made by the defendant Stephen Hall, before his marriage; and although his wife is made a party defendant, no personal claim is made against her, and she neither defends nor appears in the action. Stephen Hall, who does appear, sets up in his answer as defences: 1st. Payment of the entire claim secured by the mortgage ; and, 2d. A counter-claim to the effect that plaintiff is justly indebted to him in a sum much larger than the plaintiff's mortgage, which he alleges should be set off, and judgment rendered in…
