THAYER, Circuit Judge.
This suit was brought by John Turck, the defendant in error, against the Colorado Central Consolidated Mining Company, the plaintiff in error, to recover damages for wrongfully extracting silver-bearing ’ore from a certain lode or vein which belonged at the time to the plaintiff, John Turck. The plaintiff’s title to the lode in controversy was established by a suit in ejectment between the same parties, which was brought to this court for review, and ivas decided at the May term, A.
