FACTUAL BACKGROUND

On August 3, 2005, David Christman (Father) instituted the present proceedings seeking to modify the terms of a stipulated custody order dated November 24,2004, and asking that primary custody of the parties’ 4-year-old daughter Mallory (Child) be awarded to him.
