Several reasons have been assigned for a new trial in this case, some of which are not, in our opinion, precisely in accordance with what transpired on the trial, as the facts On the several issues were mainly left to the jury. We will pro*305ceecl to consider the issues decided in their order. 1. The jury-found that the petitioner was not the lawful wife of Daniel Fossit at the time of his death.
