Appellant was convicted of first degree murder in the Madison Circuit Court and sentenced to life imprisonment. We have heretofore granted appellant’s petition for a belated appeal pursuant to our Rule P. C. 2, Section 2.

For the sake of clarity it is necessary to review the history of this cause. On July 1, 1965, an indictment was returned in Marion County charging the appellant with first degree murder in the strangulation death of Norma Jean Toney.
