I respectfully dissent. This court does not have jurisdiction of this case. An analysis of the majority opinion reveals that it has awarded a judgment to the plaintiff on a claim for which no relief can be granted. The court has taken jurisdiction of a claim in which the government is immune from suit as a sovereign and where the Congress has not waived such immunity by giving its consent to be sued. It has rendered an opinion that amounts to a declaratory judgment that the plaintiff is entitled to recover money damages from the government in the sum of approximately $18,000, *218winch, is the…
