ORDER
KIMBALL, District Judge.
This matter is before the court on Defendants’ motions to dismiss and to strike the affidavit of Alan McCormik. A hearing on the motion was held on November 18, 2002. At the hearing, Defendants were represented by Stephen Trayner and Plaintiff was represented by Kenneth E. Atkin.
