REINHARD, Presiding Judge.
Defendant appeals his conviction by a jury of the offense of assault with intent to maim with malice aforethought. The court sentenced him under the Second Offender Act to 12 years imprisonment.
The evidence shows that at the time of the assault the defendant, Richard Page, was incarcerated in the St. Louis City Medium Security Institution, commonly known as the City Workhouse.
