This is the second appearance of this case in this court. In State v. Folsom, 285 Ga. 11 (673 SE2d 210) (2009), we set forth the facts of this case as follows:

Kenneth Doyle Folsom is charged with the kidnapping and murder of Bobby Timms. [The State has filed a direct appeal from the trial court’s pre-trial decision to suppress evidence (OCGA § 5-7-1 (a) (4)), and Folsom has filed a cross-appeal.
