— Appellant Wailes brought suit to recover ten thousand dollars, Upon the following written contract: “This indenture witnesseth, that for and in consideration of one hundred dollars in hand paid, the receipt of which is hereby acknowledged, Wm. E. Wailes has delivered Allen P. Howison the following mineral right, or options to land, viz., N. C. Blake, A. E. Blake and M. J. Blake, two hundred and twenty acres of land; P. Wallace, L>.
