(dissenting). With the reasoning and conclusion of the majority opinion I am unable to agree. Our duty in the case is to construe a paragraph of a contract which to my mind is couched in simple, straightforward language, the meaning of which is as unclouded and clear as it is possible to be made by the use of English language, and to my mind the construction which this and some other courts have., placed upon it is a perversion of the actual intention of the parties, as indicated therein.
