This was a mandamus, issued on the petition of the Southern Railroad Company,- commanding the auditor of public accounts to issue his warrant on the State treasury for an amount of money alleged to be in the treasury, and to which the railroad is entitled.
The petition states, in substance, that by an act of the legislature, passed on the 18th November, 1857, it was enacted that the three per cent, fund, then in the treasury, should be loaned in equal portions to the Southern Railroad, and four other named railroad companies; and that before receiving any portion thereof the said companies…
