This matter came before the court upon the defendant’s Motion to Dismiss the plaintiffs complaint “for the reason that the court lacks jurisdiction in this suit in that plaintiffs [sic] failed to exhaust their [sic] administrative remedies and the Department of Revenue refused to exercise its supervisory authority under ORS 311.205.”
