MEMORANDUM OPINION AND ORDER

HAIGHT, Senior District Judge:

In this diversity action, plaintiff Cameron McElroy sues defendant Gemark Alloy Refining Corporation (“Gemark”) for breach of contract. 1 Gemark now moves pursuant to Fed.R.CivJP. 56 for summary judgment dismissing McElroy’s complaint. For the reasons that follow, the motion is granted and the complaint dismissed.
