Young, J.:

The action was brought to recover damages for the breach of an alleged contract between the parties, whereby the defendant agreed to supply certain muck land and cold frames for growing celery, lettuce, etc., do plowing and look after the shipping, and whereby the plaintiff agreed to work the muck land and cold frames and supply necessary labor to raise such crops thereon as might be directed by the defendant, and the parties were to divide the proceeds in certain proportions.
