MARRERO, District Judge.

I. BACKGROUND

By its decision rendered on September 27, 2001 (the “2001 Decision”) 1 ruling on a motion for summary judgment, the Court determined that plaintiff Michael Mathias (“Mathias”) was entitled to recover damages from defendant Bradley Jacobs (“Jacobs”) for breach of a 1992 stock option agreement (the “Option Agreement” or “1992 Option Agreement”) that contained a so-called “non-contact” promise the Court held unenforceable.
