OPINION OF THE COURT
PER CURIAM. *
In this case the government appeals from the district court’s quashing “as to sentencing purposes only” of one count of an indictment after a guilty verdict by the jury.
On April 14, 1976, the two defendants in this case, Philip Davis and Louis Hazzard, were convicted by a jury on four counts of a thirteen-count indictment charging them with assaulting and robbing a postal truck driver.
