delivered the opinion of the court.

The principal question presented upon this appeal relates to the effect of the alterations made in the instrument sued upon. It is uncontroverted that these changes were made by defendant in error’s manager and about a month after the writing was signed by E. W. Wagner and by defendant in error. That the changes were in matters material, is beyond question. The contract price and date of completion were changed. We have then to determine if these changes invalidated the instrument.
