The defendant is a corporation organized under an amendment made in 1864 tó the general Incorporation Act, (Stats 1863 — 4 p. 149), and the plaintiffs are stockholders of the corporation. The action is brought to restrain the defendant from selling the shares of stock held *87by the plaintiffs under an assessment made by the Trustees of the company.
