LEMMON, District Judge.
IT IS HEREBY ORDERED that Sheriff Rodney Strain’s motion to dismiss for lack of subject matter jurisdiction, pursuant to Federal Rule Civil Procedure 12(b)(1) is DENIED. (Document #18.)
