This is an appeal from a decree and judgment of the district court of McCurtain county, decreeing distribution of the estate of Jerome B. York, deceased, and from an order overruling a motion for a new trial. Elizabeth York, the widow of Jerome B. York, is the plaintiff in error, and will be referred to herein as plaintiff, Since the filing- of this case in the Supreme Court, the plaintiff departed this life, having died on January 7, 1926, and Bank of Commerce & Trust Company has been appointed executor under her last .will and testament and has duly qualified and is acting as such, and this…
