MEMORANDUM

MERHIGE, District Judge.

Plaintiff, Ralph S. Major, Jr., doing business as Major & Associates (“Major”), commenced this action for injunctive and monetary relief on May 2, 1972. Defendant, Orthopedic Equipment Company, Inc. (“OEC”) is a corporation organized under the laws of the State of Indiana. This action arises from a contractual dispute regarding plaintiff’s status as a distributor for OEC. There being diversity of citizen ship between the parties and an amount in controversy in excess of $10,000, subject matter jurisdiction vests in the court pursuant to 28 U.S.C. § 1332.
