The plaintiff below, plaintiff •in error, sought by this action injunctive relief to prevent enforcement of ordinance No. 4524, city of Oklahoma City, commonly known as the “Segregation Ordinance.”

Under the provisions of section 1 of the ordinance it is unlawful for any white person to occupy, as a residence, any house or building located in a block wherein a majority of the lots used as residences are occupied by Negroes.
