I. Introduction

In this action Liberty Mutual Insurance Company (“Liberty”) is seeking payment on a certain surety bond that Greenwich Insurance Company (“Greenwich”) issued on behalf of American Tissue, Inc. (“American Tissue”), its principal, for the benefit of the plaintiff. Liberty provided workers’ compensation insurance coverage for American Tissue.
