Gonzalo Ledezma and his brother (or brother-in-law) Jose were both charged with *309kidnapping and sexual abuse on the basis of a complaint made by Marie Joyce Big Bear.

In the early morning hours of August 13, 1994, Marie contacted the police and informed them she had been raped by three Hispanic males. She provided the police with a license plate number of the vehicle in which the men drove away after dropping her off following the assaults.
