Defendant was sentenced to one year in the penitentiary on a verdict finding him guilty as charged. The indictment charged him with a “second” violation of the prohibition law under see. 31, chap. 32-A, Code 1923. This writ of error challenges the verdict and sentence. The errors alleged are: (1) that the demurrer to the indictment should have been, sustained; (2) that the evidence of witnesses examined by the state to prove the first alleged conviction should have .been excluded from the jury; (3) the admission of certain alleged hearsay testimony; and (4) refusal of the court…
