T1 Rhoderick Flockhart was convicted of distribution of marijuana and possession of eight ounces or more of marijuana. On appeal, the court of appeals ruled on three *230issues. First, a divided court of appeals reversed Flockhart's convictions because the trial court instructed the jury that it could discuss the case before deliberations in violation of his constitutional rights.
