In a proceeding pursuant to Election Law article 16 to invalidate the Republican Party primary election that was held on September 13, 1994, for the public office of Member of Congress for the Fourth Congressional District in Nassau County and to order a new primary election, the petitioner appeals from an order of the Supreme Court, Nassau County (Winick, J.), entered October 11, 1994, which, inter alia, dismissed the petition as time-barred.

Ordered that the order is affirmed, without costs or disbursements.
