OPINION

NUCHIA, Justice.

A jury found appellant guilty of aggravated assault and assessed punishment at 20 years in prison and a $10,000 fine. The trial court sentenced appellant in accordance with the jury’s assessment. We reverse.

BACKGROUND

The victim in this case, Charles Goodwin, is a bail bondsman. Appellant contracted with Goodwin to bond appellant out of the Washington County jail. Kenneth Darnell, a Washington County deputy sheriff, saw appellant and Goodwin leave the jail together.
