— This is a suit brought in the court below by 'the treasurer and ex officio tax collector of Pima county, in the name of the territory, against Allan R. English and his wife, to collect a delinquent special assessment levied by the city of Tucson against the property of the defendants to the suit. The assessment was levied under the provisions of chapter 2 of title 11 of the Revised Statutes of 1901 to pay, in part, for the improvement of Congress street in said city. The improvement consisted of the widening of said street by the condemnation of block No. 206, commonly known as “the Wedge.”…
