This appeal comes to us from the district court’s denial of a motion by David Lewal-len (“movant”) to order the government to return certain seized property to him. The movant based his motion on two theories: (1) the search warrants used to seize his property were based on false statements by the affiant in violation of the standard set forth by the Supreme Court in Franks v. Delaware, 438 U.S. 154, 98 S.Ct. 2674, 57 L.Ed.2d 667 (1978); and (2) the procedure used to seize movant’s bank records violated 12 U.S.C. § 3420, which is a section of the Right to Financial…
