Petitioner filed suit against Respondent in the District Court of Cherokee County, Texas, on an insurance policy for recovery of the sum of $187.50, alleged to be due by virtue of the death of Addie Bagley, one of the insureds under said policy. Andrew F. Bagley was the beneficiary named in the policy. The Petitioner further sought a declaratory judgment construing the terms of the policy and an Assumption Certificate issued by Respondent.
