OPINION

{¶ 1} This matter is before the Court on the two separate Notices of Appeal of Myles Ian Scott, filed December 1, 2006, which we consolidate for analysis. Scott was indicted by a Montgomery County Grand Jury, on April 26, 2006, on one count of burglary, in violation of R.C.2911.12(A)(3), and one count of theft, in violation of R.C.2913.02(A)(1), in case number 2006 CR 718/2 ("the first case"). On May 11, 2006, bond was initially set at $7500. On May 23, 2006, Scott was granted a conditional own recognizance bond and released from jail.
