THOMPSON, District Judge.

The indictment contains nine counts. Count 1 charges that “the said defendant, William C. McConnell, being then and there an officer or agent appointed and acting under the authority of a revenue law or revenue provision of a law of the United States, viz. the National Prohibition Act [Comp. St. Ann. Supp. 1923, § 10138% et seq.] and supplements and regulations, did willfully, knowingly, and unlawfully make an opportunity for a person or persons presently to this grand inquest unknown to defraud the United.
