Wilbert Roberts, the defendant in error, by Albert Roberts, Eis next friend, brought an action on the case in the circuit court of Edgar county against the Cleveland, Cincinnati, Chicago and St. Louis Railway Company, plaintiff in error, to recover damages for personal injuries sustained by him on April 20, 1913, while in the employ of plaintiff in error. The original declaration consisted of three counts.
