Missouri Court of Appeals

Decided May 5, 1891PublishedCited by 2 opinions

Appeal from the Phelps Circuit Court. — Hon. C. C. Bland, Judge.

1Opinion of the CourtBiggs, J.

— This is a landlord’s action by attachment for the recovery of rent. The attachment was sustained and a judgment entered for $300, the amount of rent admitted by defendant to be due to the plaintiffs.

*203On this appeal the defendant urges the following assignments of error: First. The court committed, error in overruling the defendant’s motion to quash the writ of attachment. Second. The amended plea in abatement was erroneously stricken out. Third. The judgment should have been general and not special, and the costs of the litigation ought to have been taxed against the plaintiffs.
