Garnett H. Tyner III instituted two actions to foreclose materialmen's liens against construction projects of Holbrook Contracting, Inc. (Holbrook), claiming he was owed one-half the net profits (approximately $22,000) for labor and materials furnished on those projects. Holbrook answered and counterclaimed for conversion of equipment held by Tyner and for malicious abuse of process.…
